Novant, LLC, a Virginia limited liability company, (”we,” “us,” or “Company”) takes your privacy seriously. This written privacy policy (this “Privacy Policy”) governs the data collected by us through our website at https://novant.io/ (collectively, our “Site”), including, your information, and how we use the same. By accessing/browsing our Site, creating an account, using the services, subscribing to our newsletter (if any), purchasing our products, or any combination of the same, you agree to be bound by this privacy policy (this “Privacy Policy”).

1. Your Agreement

You affirm that you have authority to agree to this Privacy Policy, and are competent and capable of understanding, agreeing to, and complying with this Privacy Policy. You agree that this Privacy Policy is supported by reasonable and valuable consideration (which consideration includes your use of our Site), and you acknowledge your receipt of and the sufficiency of the consideration. If you do not agree with all of the provisions of this Privacy Policy, do not use our Site.

When you are no longer an active user of our Site, we may continue to use and share your information as described in this Privacy Policy. This Privacy Policy only applies to our use of information collected from you. It does not apply to the practices of any bank or payment processor used by Company or for other third-party transactions related to your activity on our Site.

Throughout this Privacy Policy, we use the term "Personal Information" to describe information that can be associated with a specific person and can be used to identify that person. We do not consider personal information to include information that has been aggregated, anonymized, or both, so that it does not identify a specific user. Company will own such aggregated and anonymized information. “Personal Information” for purposes of this Privacy Policy also does not include information that would be visible to visitors to our Site or visible to other users of Company services and products.

Self-Reported Information

We might collect your name, email address, address, phone number, zip code, and other similar contact information, which you provide directly to us. You might provide us with information in a number of ways, including, without limitation by taking any or all of the following actions: (i) subscribing for our newsletter (if any), (ii) emailing us, (iii) registering a user account to access certain types of our services and products, or (iv) purchasing a service or product through or from us.

User Content

You might be provided with the ability to post, submit, upload, embed, display, communicate, or otherwise distribute text, data, graphics, external links, or other materials (“User Content”). We collect User Content when you submit it to us, providing us feedback, or while using the services. User Content may be stored by us, displayed to other users, or used for promotional purposes. User Content may be read, collected, and used by third parties. You should exercise caution before you share Personal Information in your User Content.

We collect information from your computers or mobile devices, either directly or via analytics partners, including your activity on our Site across devices. This includes data such as IP addresses, geo-location, time zone, cookie information, mobile device, advertising identifiers, browser and version, operating system type and version, mobile network information, device settings, and software data. We may recognize your devices to provide you with personalized experiences across the devices you use.

Our analytics partners collect location information from sources such as IP addresses and mobile phone network data. You can manage your location preferences and opt out of location tracking by using the location settings on your devices and within your web browser.

We collect information about how you and your device interact with our Site and our services and products, including, for example: (1) referring source (i.e., the site you visited prior to visiting our Site); (2) date and time of access to our Site; (3) our Site pages visited and our Site features used, and the order of use; (4) type of computer or other operating device accessing Site, type of browser used to access our Site, and type of operating system you use; and (5) other similar information about the interaction between your browser and our Site. We collect and store technical information through information gathering tools such as cookies, web beacons, and other similar technologies.

Cookies

Cookies are stored in a computer or other operating device’s memory during a user’s browsing session. The cookies we use in connection with our Site are automatically deleted from the user’s computer or operating device when the browser is closed and the session has ended. These cookies usually store a session ID that does not personally-identify the user, and they allow users to navigate our Site efficiently. These cookies provide us information about our Site features used and activities conducted while using our Site. Generally, we use cookies to customize your experience while using our Site and analytics. We may use cookies to compile aggregate data about user traffic on and user interaction with our Site so we can offer better experiences and tools in the future. Web Beacons

We may use web beacons (also called clear GIFs or pixel tags) or similar technologies to collect technical information about your use of our Site and your viewing and use of emails we send to you. Web beacons are graphic image files embedded in a web page, our Site feature, or email that provide a presence on such web page, feature, or email and send back to its home server information from the user’s browser. The information collected by web beacons allows us to statistically monitor how many people are using our Site and opening our emails, and for what purposes. For example, we might place a web beacon in a marketing email to notify us when a user clicks on the link in the email. We do not collect Personal Information with web beacons, and we do not link information retrieved from web beacons directly with Personal Information you have given us.

3. How We Protect And Store Personal Information

We store and process your Personal Information using third party servers located in data centers in the United States. We also use customary computer safeguards such as firewalls and data encryption, enforce physical access controls to our office and files, and authorize access to personal information only for those who require it to fulfill their responsibilities for Company.

We strive to ensure security on all of our systems. Despite our efforts, we cannot guarantee that personal information will not be accessed, disclosed, altered, or destroyed by breach of our administrative, managerial, and technical safeguards. Safety and security of your Personal Information also depends on you. You should not send us credit card information or other sensitive information via email, as this is not secure. If you create an account on our Site, you are responsible for keeping your username and password confidential. Please notify us if you become aware that your Personal Information is lost, stolen, or used without permission. We may disable access to your Site account, if any, in order to prevent an unauthorized third party from accessing your account. Further, in the event of an unauthorized use of your credit card, you should contact your card issuer immediately. We urge you to take adequate precautions to protect your personal data, including, without limitation, not sharing your password should you have an account with us.

If we learn of a systems security breach, we will attempt to notify you electronically so that you can take appropriate steps. By using our Site, you agree that Company may communicate with you electronically. We may post a notice on our Site if a security breach occurs. We may also send an email to you at the email address you have provided to us. You consent to receive notices by email. You agree to provide us up-to-date contact information, including a functional email address which is checked on a regular basis. Depending on where you live, you may have a legal right to receive notice of a security breach in writing. 4. International Data Transfers

As noted above, we store and process Personal Information using third party services located in data centers in the United States. If you reside outside of the United States, your information will be transferred or transmitted to, or stored and processed in the United States for the purposes as described in this Privacy Policy. These data transfers are necessary to provide our goods and services. Your country might have data protection rules different from the United States. When transferring data across international borders, we use standard contract clauses and take reasonable measures to comply with applicable data protection laws related to such transfer. We might be required in certain instances to disclose Personal Information in response to lawful requests from officials, such as law enforcement or security authorities.

5. How We Use the Personal Information We Collect

We rely upon a number of legal bases to enable our processing and use of Personal Information, including contractual business relationships, legitimate business interests, legal compliance, and your consent. Company uses your Personal Information for the purpose stated when we ask for such Personal Information. We also use such Personal Information as described elsewhere in this Privacy Policy to provide our Site and its features and to send you communications, including, to:

If we use your Personal Information to send you marketing communications, we will provide you with an unsubscribe mechanism to opt-out of receiving future marketing communications, or you can contact us to request that we not send you marketing communications. If you request that we not contact you for marketing purposes (either by using the unsubscribe mechanism or contacting us), we reserve the right to contact you for non-marketing purposes relating to your purchases or other use of our Site.

6. How We Share Personal Information

6.1. Information Shared with Third Parties

We do not share, sell, rent, license, trade, or otherwise transfer or disclose your Personal Information with or to third parties for their promotional purposes. We may share de-identified, aggregated information without restriction.

6.2. Third-Party Service Providers

We share information with our third-party service providers who assist us by performing services related to our operation of our Site (such as hosting, data storage, payment processing, fulfillment, and security) and to conduct marketing on our behalf.

6.3. Third-Party Analytics Services

We may use third-party analytics services to assist us in better understanding users of our Site. For example, we may use these services to track and analyze certain information, such as feature usage. We only ever provide these service providers with (or allow these service providers to collect on our behalf) the technical information described above. We use the information collected from these service providers to make our Site better and easier to use. In particular, we use Fathom Analytics to evaluate and improve our Site and off you more personalized services and products.

6.4. Merger, Acquisition, or Sale

We may transfer your Personal Information to another entity owned or controlled by Company or its members or another entity if Company is involved in a merger, acquisition, reorganization, restructuring, or other sale or transfer of all or any portion of its assets or business, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding in which information of our Site users are among the assets transferred. In this event, we will, if allowed, use reasonable efforts to notify you when your information is transferred to a third party (this notification may be made via email to you or by posting a prominent notice on our Site). Unless you consent otherwise, your Personal Information will remain subject to the promises made in this Privacy Policy, even after the transfer. But any information you provide after the transfer will likely be subject to a new privacy policy, and you should review that policy.

6.6. Public Areas of Site

Our Site, from time to time, might contain areas where users can post User Content that will be viewable by other users of our Site or affiliated sites. You should be aware that when you voluntarily disclose Personal Information on these areas of our Site for public viewing, the information may be collected, stored, used, and disclosed by other users of our Site. Such activities are beyond our control, and we will have no responsibility for or liability regarding the protection or security of such User Content. Do not post Personal Information that you want to keep private on these areas of our Site.

7. Controlling Your Information

7.1. Controls

You can manage or review your account information, marketing preferences, and user data. If you would like to receive a copy of your Personal Information in our records, including, a machine-readable copy of your Personal Information, or would like to correct or remove such information from our records, please contact us at support@novant.io. See above regarding how to opt out of receiving marketing communications. In addition, you may log into your account, if any, to update your account information. Please email us at support@novant.io if you would like us to fully-delete your account, if any, and all account information.

7.2. Retention and Storage of Information

We may retain all Personal Information in our databases until you ask us to remove your information from our databases. Note that even after you ask that we remove your information from our databases, it may be impossible to remove some information, such as information tracked in our web server log files and information that may reside in backup files. This residual information is retained to preserve the integrity of backed-up files and for business continuity purposes. We may also retain certain technical information even after you request that we remove your information from our databases, for use in the aggregate and to analyze and improve our Site and affiliated sites. Further, even after you request that we remove your information from our databases, we may retain Personal Information with any document retention policy and to comply with applicable laws, rules, regulations, or guidelines; to prevent fraudulent activity; to protect ourselves against liability; to resolve disputes; to enforce our contractual or other rights; to permit us to pursue available remedies and limit any damages that we may sustain.

7.3. Do Not Track

We do not track our users over time and across third-party websites to provide interest-based advertising and therefore do not respond to Do Not Track signals. Further, by default, Fathom Analytics does not track personal data, so when someone visits our Site, it will log that a page was visited, but not by who specifically. For these reasons, our Site does not support Do Not Track (DNT) at this time. DNT is a privacy preference you can set in your web browser to indicate that you do not want certain information about your web page visits tracked and collected across websites. 8. California Residents

California residents have certain rights under the California Consumer Privacy Act (“CCPA”). Please note that the CCPA does not apply to nonpublic personal information collected by financial institutions, which is regulated by other laws.

Subject to limitations and exceptions, the CCPA provides California residents the right to request details about the categories and specific elements of personal information we collect, to delete their personal information, to opt out of any “sales” that may be occurring, and to not be discriminated against for exercising these rights. Choices available to you for the collection and handling of your information are addressed throughout Privacy Policy.

We collect the following categories of personal information subject to the CCPA: identifiers (such as email address and IP address), approximate geolocation information, and Internet or other electronic network activity information (such as browsing history and related usage data).

For more details about the information we collect and the categories of sources of this information, please see the above sections of this Privacy Policy. We share this information with the categories of third parties described in the “HOW WE SHARE PERSONAL INFORMATION” section above.

California residents may make a request for access to certain personal information subject to the CCPA, not otherwise exempted as nonpublic personal information collected by financial institutions, by sending an email to support@novant.io. We may verify any such request by asking you to provide information that matches information we have on file about you. You can also designate an authorized agent to exercise these rights on your behalf, but we will require proof that the person is authorized to act on your behalf and may also still ask you to verify your identity with us directly.

9. Age Limitations

We provide a business-to-business service and do not knowingly solicit or collect information from anyone under the age of 18. In the event that we learn that we have inadvertently collected personal information from someone under age 16, we will take reasonable steps to delete that information. 10. Links to Other Sites

This Privacy Policy applies only to information collected through your use of our Site. Our Site may contain links to other third-party websites, products, or services that are not owned or controlled by Company. We do not control the information collection of third-party websites that can be reached through links from our Site, including, third-party service provider for merchant services and providing other services in connection with our Site. We encourage our users to be aware when they are leaving our Site and to read the privacy statements of any third-party website that collects personally identifiable information.

11. Changes to this Privacy Policy; Subject to Terms of Use

Company may update this Privacy Policy. If we do, we will post a new privacy policy here. You should review this Privacy Policy regularly to make sure you are aware of its terms. If we make material changes, we will notify you by posting an announcement on our mobile application, on the homepage of our Site, or by sending you an e-mail. It is your responsibility to periodically review this Privacy Policy; users are bound by any changes to the Privacy Policy by using our Site after such changes have been posted. This Privacy Policy is subject to our Site’s Terms of Use.
